GALAPAGOS LAND TOURS                                      ECUADOR DAY-TOURS

* NOTE: The following Terms, Conditions and Cancellation Policies are applicable to DIRECT ONLINE BOOKINGS of our Galapagos Land Tours and Ecuador Day-Tours ONLY.

The following terms and conditions will be applied by Nature Galapagos & Ecuador Cia. Ltda. (NG&E) from the moment of reservation and booking of all touristic services involved in our Galapagos Land Tours.The payment for the reservation and invoice implies the approval and consent of the following contract terms and conditions:

  1. NG&E acts as an intermediary in the reservation and hiring of some of the services between its traveler(s) and Secondary Supplier. The term Secondary Supplier may refer to hotels, transportations (via air, land or water), excursions and/or combined packages carried by local operators, companies and/or the municipalty  in the the Galapagos Islands.The complete confirmation of such services and the final costs applied can only be guaranteed through the emission on the respective invoice/bill and the Service Voucher and/or the air tickets. Such services are subject to the conditions previously agreed with the secondary supplier, being exclusive and direct responsibility of the Secondary Supplier the successful completion of such services. NG&E does not take responsibility for any accident, injury, loss, change and/or act of God beyond the control of the Secondary Supplier.
  2. NG&E as well as the Secondary Supplier assume that the traveler(s) is/are in good health conditions and aware of the physical demands, techniques, altitude and climatic variations and all risks entailed in each activity during the tour.
  3. NG&E highly recommends to all travelers to get an travel insurance policy covering material losses, accidents, delays, air ambulance services and life loss. Medical evacuations by air ambulance to the mainland take at least 48 hours to arrange.
  4. NG&E does not provide any sort of travel insurance along with their programs (either on the Galapagos or the mainland). The costs of the programs offered by NG&E do not comprise coverage for accidents or events beyond our control.
  5. COSTS: will include all the services detailed in this invoice and the Service Voucher as previously discussed and agreed with the traveler(s).In case NG&E arranges lodging bookings for traveler (s), it is the traveler(s) responsability to comply with the rules as well as the check-in and check-out hours of the specific hotel, hostel or lodge. The traveler(s) is/are responsible for all room fittings and/or all equipment used for each activity on their itinerary.
  6. NG&E tours mark the day of departure as as day one (Day 1) of the trip. The last day of the tour will end with the completion of all services as previously agreed with the traveler(s) regardless of the time of the day.
  7. All online bookings are subject to revision by the NG&E travel agents before the final confirmation is settled. In order to ensure availability and quality services, NG&E reserves the right to reject or cancel a booking, in which case an immediate refund will be made via your Pay Pal account.
  8. All online bookings are done via Pay Pal, we do not collect any credit card information (number, expiration date, nor security code) as we don’t process the payment directly. Your Pay Pal account should take care of all security and  information encryption.  Please refer to our Privacy Policy regarding this point.
  9. The Service Voucher and/or Flight Ticket (Electronic or Printable) are the only warranty of the activities agreed between NG&E and the travelers(s) – services and activities not listed in the Service Voucher will not be included during the tour and might representa en extra cost for that traveler(s) will have to assume. Airport taxes, museum entrance fees, national park entrance fees, and communication costs are NOT INCLUDED in our Galapagos Programs, unless there is a previously established agreement between the two parties on the inclusion of such services. Food, drinks, lodging, airport transfers and tips are NOT INCLUDED in mainland Ecuador (continent) either upon arrival or departure, unless there is a previously established agreement between the two parties for such services.In case the traveler(s) stay in the country has to be prolongued due to forces beyond our control (i.e. drastic seasonal changes), last minute weather conditions, terrorist activities, natural disaster, delayed arrival, unforeseen accidents, etc., NG&E takes no responsibility in assuming these expenses, traveler(s) will be responsible for all additional costs.
  10. LAST MINUTE CANCELATIONS: NG&E reserves the right to cancel and/or modify activities in the itinerary if it is considered there is imminent physical risk for the traveler(s), company staff or damage to company property or due to events beyond control. Please, consult our cancellation polices below or ask for more information to a  NG&E agent.
  11. NG&E reserves the right to exclude the traveler(s) from the programmed activities due to health conditions, threatening behavior or other justifiable reason involving the wellbeing of themselves, other travelers or safeguarding the right course of the activities. In such case, NG&E will not refund for any lost activity, even if included in the Service Voucher. In case of further controversy, the traveler(s) will be subject to the laws of the Ecuadorian Legislation.
  12. INABILITY TO PERFORM:
    We will endeavor to guarantee tours as far in advance as possible; however, some tours (especially land- based tours) cannot be guaranteed until 45-60 days prior to departure. Should the program be canceled due to lack of enrollment, you will be contacted as soon as possible after Nature Galapagos & Ecuador is notified of the cancellation. The program can be re-booked with no charge.
    Nature Galapagos & Ecuador shall not be liable for debacle or inability to perform its cruises of the Galapagos Islands and tours of mainland Ecuador by reasons of strikes or industrial action, mechanical breakdown, fire, explosion, collision or damage to the hull or accommodations and fittings of its vessels, war, riot, acts of terrorism, civil commission, inability to obtain supplies and other circumstances beyond its control, including answering any distress call or any action necessary to save or preserve life at sea.
    Nature Galapagos & Ecuador may, due to circumstances of force majeure, or unexpected events, vary the time of day of its departures of its vessels and tours, or alter its tour programs and itineraries without advance notice for the above mentioned reason including changing weather and the forces of nature, wildlife nesting habits, the vessel’s safety, the safety of its passengers and crew, the discretion of the Galapagos National Park and technical reasons.
    Under the aforementioned conditions, Nature Galapagos & Ecuador is under no obligation whatsoever to provide a substitution, replacement of services or refunds to any of its passengers so affected.

 


GALAPAGOS LAND TOURS  by Nature Galapagos & Ecuador

  1. Deposits and Payments

 

         1.1.      Individual Fit’s Passengers:

 

  • 30% deposit of the total invoice is required to confirm the reservation. Additional 100% for tickets issued through us.
  • 30% An additional deposit of the total invoice is required 121 days before the date of departure.
  • Remaining 40% balance must be paid 61 days before the departure date, together with names, passport numbers, nationality, rooming list, allergies or illnesses, and food restrictions.
  • Tours confirmed within 90 days before the departure, payment in full is required for confirmation.
  1. Cancellation and Penalties:

 

        2.1.      Individual Fit’s Passengers:

 

  • 121 days prior to the departure, spaces can be release and an administration fee of 20% of the total invoice withheld, considering services involves guide, hotel, or third-party reservations (different policies of each service provider could be applied if any). Refund 10%
  • Air tickets: Galapagos air tickets are issued at the moment of the confirmation, 100% cancellation fees, and airline policies for changes are applied.
  • 120-91 days prior to the departure, 50% of the total invoice will be retained. Refund 10%
  • 90-61 days prior to the departure, a 60% deposit is forfeited (cancelation fee equal to the deposit paid will be charged).
  • 60 days prior to the departure confirmation is considering firm and 100% of the total negotiated rate will be charged.

IMPORTANT NOTE: Payment policies regarding cruises may change according to each boat operator.

  • No cancellations, refunds or compensations are issued by Nature Galapagos & Ecuador if an event of Force Majeure, or act of God, is occurring that prevents the provision of the service. Each case will be analyzed individually by Nature Galapagos & Ecuador to decide and inform if there is a possibility to reschedule new dates. If so, this will be put to the consideration of the customer, always subject to availability.

PROMOTIONAL DEALS

  • Immediate non-refundable full payment is mandatory. Special deals apply to new bookings only. Spaces are limited, and promo deals might be modified or withdrawn without previous notice. Different offers cannot be combined.

The term Secondary Supplier refers to Operation Carriers of our Quito Day Tours.The complete confirmation of such services and the final costs applied can only be guaranteed through the emission on the respective invoice/bill and the Service Voucher. Such services are subject to the conditions previously agreed with the Secondary Supplier, being exclusive and direct responsibility of the Secondary Supplier the successful completion of such services. NG&E does not take responsibility for any accident, injury, loss, change and/or act of God beyond the control of the Secondary Supplier.
  2. NG&E as well as the Secondary Supplier assume that the traveler(s) is/are in good health conditions and aware of the physical demands, techniques, altitude and climatic variations and all risks entailed in each activity during the tour.

NG&E and the Secondary Supplier reserve the right to cancel or modify the tour itinerary due to force majeure or acts of providence such as wars, internal commotion, protests/strikes, terrorism, fire, natural disasters, public authority decisions, or any other extreme circumstances; this may include substitution with a comparable yacht, guide, hotel, transport, meals, sightseeing destinations.
  10. NG&E and the Secondary Supplier reserves the right to exclude the traveler(s) from the programmed activities due to health conditions, threatening behavior or other justifiable reason involving the wellbeing of themselves, other travelers or safeguarding the right course of the activities. In such case, NG&E will not refund for any lost activity, even if included in the Service Voucher. In case of further controversy, the traveler(s) will be subject to the laws of the Ecuadorian Legislation.

ECUADOR DAY-TOURS by Nature Galapagos & Ecuador

CANCELLATION POLICIES (for online bookings)

1. Booking’s Policies: 1.1. Individual FIT Travelers (less that 5 traveleres):

  • 100% of the Tour program per passenger is required to confirm your day-trip.

2. Cancellation Policies: 2.1. Individual FIT Travelers (less that 5 traveleres):

  • Cancelations made 11 days pior to departure will have no penalty and the total value paid for the day-tour will be refunded.
  • Cancelations made from less that 11 days to 48 hours prior to departure will have a penalty of 50% of the total value paid for the day-tour.
  • Cancellations made less than 48hours prior to departure will have a penalty of 100% of the total value paid for the day-tour, no refunds are possible.
